(a) The department will accept and investigate all
written complaints on a specific sign structure, sign company, or
any other issue under the jurisdiction of the highway beautification
program.
(b) The complaints can be filed through the department's
website, www.txdot.gov. or by mail sent to: Texas Department of Transportation,
Commercial Signs Regulatory Program Section, Right of Way Division,
P.O. Box 5075, Austin, Texas 78763-5075.
(c) If the complaint involves a sign structure or a
sign company, the department will notify the owner of the sign structure
or sign company of the complaint and the pending investigation not
later than the 15th day after the date of receipt of the complaint.
The notification will include a copy of the complaint and the complaint
investigation procedures.
(d) If the complaint included contact information,
the department will provide the complainant with a copy of the complaint
procedures not later than the 15th day after the date of the receipt
of the complaint.
(e) If the complaint involves fewer than 10 sign structures,
the department will investigate the complaint and make a finding not
later than the 30th day after the date of the receipt of the complaint.
If the complaint involves 10 or more sign structures or is an investigation
of a sign company or any other sign matter, the department will make
a finding not later than the 90th day after the date of the receipt
of the complaint.
(f) If the department is unable to meet the deadlines
provided by subsection (e) of this section, the department will notify
the complainant, the sign owner, or sign company of the delay and
will provide a date for the completion of the investigation.
(g) After the investigation is completed, the department
will provide the complainant, sign owner, or sign company the findings
of the investigation and a statement of whether the department will
initiate administrative enforcement actions.
