RULE §83.2003Attempted Evasion of Applicability of Chapter

A "device, subterfuge, or pretense to evade the application" of this chapter, as used in Texas Finance Code, §393.602(c) refers to any transaction that in form may appear on its face to be something other than a deferred presentment transaction or a motor vehicle title loan, but in substance meets the definition of a deferred presentment transaction or a motor vehicle title loan as defined in Texas Finance Code, §393.602.
