(a) Child Care Regulation (CCR) is responsible for
inspecting or investigating:
(1) An operation that is subject to regulation under
Texas Human Resources Code (HRC) Chapter 42 to:
(A) Monitor the operation's compliance with statutes,
rules, and minimum standards; and
(B) Investigate an allegation of non-compliance with
statutes, rules, and minimum standards; and
(2) An unlicensed program providing care to children
to determine whether the program is subject to regulation by CCR.
(b) The following entities are responsible for investigating
an allegation of abuse, neglect, or exploitation:
(1) The Texas Department of Family and Protective Services
is responsible for investigating an allegation of child abuse, neglect,
or exploitation at an operation that is subject to regulation under
HRC Chapter 42, as described in Title 40, Part 19, Chapter 707, Subchapter
C, Child Care Investigations; and
(2) The Texas Health and Human Services Commission
(HHSC) is responsible for investigating an allegation of abuse, neglect,
or exploitation of an elderly adult or an adult with a disability
in a residential child-care operation, as described in Texas Human
Resources Code, Chapter 48, Subchapter F.
(c) An authorized representative of CCR may inspect
under subsection (a) of this section during or after an investigation
under subsection (b) of this section.
