Transportation Code, §203.0922, provides that the Texas Transportation Commission may authorize the establishment of a prepayment funding agreement program to reimburse a utility for the costs of relocating certain utility facilities required by the improvement of a segment of the state highway system, including a toll project on the state highway system. This subchapter applies only to an adjustment, modification, relocation, or removal of a utility facility for that portion of the work for which the utility is not eligible for reimbursement under Transportation Code, §203.092.
