(a) The executive director shall have the duties, responsibilities,
and authority to take action as necessary, including but not limited
to emergency rulemaking, to modify state coastal fisheries regulations
to conform with federal regulations in the Exclusive Economic Zone
and implement fishery management plans ultimately approved by the
Secretary of Commerce, including but not limited to Exempted Fishing
Permits (EFPs), when such action is deemed to be in the best interest
of the State of Texas.
(b) The executive director shall promptly notify the
chairman of the commission when any such action is required and prior
to any such action being taken.
(c) The executive director shall cause to be published
in the Texas Register a public notice
of any action taken, including the period during which such action
is to be in effect, pursuant to subsection (a) of this section.
(d) Any action taken by the executive director pursuant
to this section shall remain in effect for the period specified for
such action, but shall not exceed the effective period of the respective
federal regulation in the Exclusive Economic Zone.
