|(a) In order to be eligible to elect hospice care under Medicaid,
an individual must:
(1) be certified as Medicaid eligible by the Texas Department
of Human Services (DHS) or the Social Security Administration (SSA);
(2) be certified as being terminally ill in accordance with §30.14
of this title (relating to Certification of Terminal Illness); and
(3) have an identified need documented on the comprehensive
assessment for one or more of the following:
(A) medical care;
(B) skilled nursing care related to the management of pain
and symptom control;
(C) medical social services; or
(D) emotional or spiritual care.
(b) If dually eligible, the recipient must elect the hospice
benefit under both the Medicare and Medicaid programs.
