(a) Except as provided by this chapter, the owner
or operator of each boiler operated in this state must:
(1) register the boiler with the department;
(2) have qualified each boiler for a current certificate
of operation; and
(3) post the current certificate of operation in a
conspicuous place on or near the boiler for which it is issued.
(b) Upon issuance of a certificate of operation for
a boiler:
(1) the obligation to comply with the Act and this
chapter, including the requirement for periodic inspections, is required
to continue operation; and
(2) the continued operation of the boiler is presumed
unless the owner or operator establishes to the satisfaction of the
department, based on the owner or operators' records or other evidence
reasonably acceptable to the department, that the boiler was not in
operation after the expiration of a certificate of operation for that
boiler.
