(a) Right of an individual eligible for Medicaid
to request a fair hearing. Any individual eligible for Medicaid whose
request for eligibility to receive LMHA or LBHA services is denied
or is not acted upon with reasonable promptness, or whose services
have been terminated, suspended, or reduced by HHSC, is entitled to
a fair hearing in accordance with 1 TAC Chapter 357, Subchapter A
(relating to Uniform Fair Hearings Rules).
(b) Right of an individual not eligible for Medicaid
to request an appeal. Any individual who has not applied for or is
not eligible for Medicaid, whose request for eligibility to receive
LMHA or LBHA services is denied or is not acted upon with reasonable
promptness, or whose services have been terminated, suspended, or
reduced by a provider, is entitled to notification and right of appeal
in accordance with 25 TAC §401.464 (relating to Notification
and Appeals Process).
(c) At any time, an individual may contact the Ombudsman
for additional information and resources by calling toll-free (1-800-252-8154)
or online at hhs.texas.gov/ombudsman.
