Emergency protective services may be provided to an alleged
victim who is also the subject of an investigation conducted by HHSC
PI and:
(1) receives services from a provider as defined by
Texas Human Resources Code, §48.251(a)(9); or
(2) lives in a residence that is owned, operated or
controlled by a provider of home and community-based services under
the home and community-based services waiver program described by
Texas Government Code, §534.001(11)(B), regardless of whether
the alleged victim is receiving services under that waiver program
from the provider.
