SUBCHAPTER BHAZARDOUS WASTE MANAGEMENT GENERAL PROVISIONS
RULE §335.43Permit Required

(a) Except as provided in §335.2 of this title (relating to Permit Required), no person shall store, process, or dispose of hazardous waste without first having obtained a permit from the Texas Commission on Environmental Quality (commission).

(b) Upon receipt of federal Hazardous and Solid Waste Act (HSWA) authorization for the commission's Hazardous Waste Program, the commission shall be authorized to enforce the HSWA provisions that the United States Environmental Protection Agency imposed in hazardous waste permits that were issued before the HSWA authorization was granted.
