(a) If a person violates any provision of the Act,
the rules, TAS, or an order of the executive director or commission,
proceedings may be instituted to impose administrative sanctions,
administrative penalties, or both administrative penalties and sanctions
in accordance with the provisions of the Act; Texas Occupations Code,
Chapter 51; and Title 16, Texas Administrative Code, Chapter 60 (relating
to the Texas Commission of Licensing and Regulation).
(b) It is a violation of the Act for a person to perform
a plan review or inspection function of the department, unless that
person is a department employee or a registered accessibility specialist.
A person who is not a registered accessibility specialist and performs
a plan review or inspection function of the department is subject
to administrative penalties in accordance with the Act or Texas Occupations
Code, Chapter 51 and Title 16, Texas Administrative Code, Chapter
60.
(c) Cheating on an examination is grounds for denial,
suspension, or revocation of a license, imposition of an administrative
penalty, or both.
