RULE §334.494Closure and Facility Expansion

A person who stores or treats petroleum-substance waste at a Class A or B facility shall notify the agency in writing of any closure activity or facility expansion not specifically stated in the original application for registration at least 30 days prior to conducting such activity. Such person shall submit to the agency upon request such information as may reasonably be required to enable the agency to determine whether such activity is compliant with this subchapter and whether additional public notice should be conducted. Any information provided under this section shall be submitted to the agency's office in Austin and to the appropriate regional office.
