| (a) The purpose of this subchapter is to establish minimum standards for facilities subject to this subchapter under subsection (b) of this section. Nothing in this subchapter shall be construed to restrict the commission's authority to implement §335.4 of this title (relating to General Prohibitions) and the provisions of Texas Water Code, Chapter 26. (b) This subchapter applies to the following types of facilities at which nonhazardous industrial waste is stored, processed, or disposed: (1) any new commercial industrial nonhazardous waste landfill facility; and (2) any existing commercial industrial nonhazardous waste landfill facility with an areal or capacity expansion of the commercial industrial nonhazardous waste landfill. (c) This subchapter does not apply to municipal solid waste facilities at which nonhazardous industrial waste is managed. |
