| (a) An RMA may request the commission to transfer a department owned and operated ferry to an RMA. (b) A request submitted under subsection (a) of this section must be in writing and must include: (1) an explanation of how the proposed transfer is an integral part of the region's overall plan to improve mobility in the region; (2) an explanation of how the request complies with §26.43(a)(3) and (4) of this subchapter; (3) copies of any completed studies concerning the transfer; (4) a brief description of any known environmental, social, economic, or cultural resource issues, such as impacts on wetlands and other water resources, endangered species, parks, neighborhoods, businesses, historic buildings or bridges, and archeological sites concerning the transfer; and (5) the name and address of any individuals or organizations known to be opposed to the transfer, and a description of any known controversies concerning the transfer. |
