RULE §21.904Exceptions

Exceptions to any design, location, or method of installation provision in this subchapter may be authorized by the department. Requests for exceptions will be considered only where it is shown that extreme hardship or unusual conditions provide justification and where alternate measures can be prescribed in keeping with the intent of this subchapter. All requests for exceptions shall be fully documented including design data, cost comparisons, and other pertinent information. Exceptions must be recommended by the district engineer and authorized by the director of the Right of Way Division.
