| (a) The Texas Department of Transportation may lease
any highway right of way not currently needed for highway purposes
to a saltwater pipeline operator.
(b) This subchapter establishes leasing requirements
and procedures for lease of right of way by saltwater pipeline operators
and implements Natural Resources Code, Chapter 91 Subchapter T. This
subchapter applies only to leasing and not to other permissive uses
of the right of way.
(c) The procedure provided by this subchapter is separate
from and in addition to the procedures established under Subchapter
L of this chapter (relating to Leasing of Highway Assets).
