RULE §23.43Discontinuance of Assessment

If a referendum is held for the discontinuance of an assessment and the Commissioner certifies the results in favor of discontinuance, then the assessment collection shall become void immediately. All commodity process points shall be notified by registered or certified mail by the board within 10 days to discontinue collection of the assessment. The board must submit to the Commissioner within 90 days a plan of disbandment. All remaining money after obligations have been paid shall be expended for projects of research, disease and insect control, predator control, education, and promotion, designated to encourage the production marketing and use of the agricultural commodity upon which the assessment was levied. Books will be audited and will be filed with the Commissioner.
