The owner or operator shall provide the following information
in a Corrective Action Effectiveness Report (CAER):
(1) a summary of the corrective actions taken since
the last reporting period;
(2) a statistical comparison of the following groundwater
monitoring data in accordance with §352.931 of this title (relating
to Groundwater Sampling and Analysis Requirements):
(A) the groundwater protection standards;
(B) the initial exceedances of the groundwater protection
standards of §352.951(b) of this title (relating to Assessment
Monitoring Program); and
(C) the current (i.e., at the time of CAER submittal)
exceedances of the groundwater protection standards of §352.951(b)
of this title;
(3) an estimate of the percentage of the corrective
actions which have been completed;
(4) an estimate, in years, of the additional time necessary
to complete the corrective actions;
(5) a determination whether sufficient progress is
being made to achieve the selected remedy within a reasonable timeframe,
given the circumstances of an impacted property; and
(6) any other information as required by the executive
director.
