(a) Each member board shall be responsible for reviewing
any licensing matters and questions raised or brought to it by agency
staff regarding an application or renewal. The member boards may utilize
committees to address application or licensing matters, and shall
provide the Council with a recommendation as to any licensing matters
or questions raised or brought to it by agency staff regarding an
application or renewal.
(b) The Council shall review all licensing matters
for anti-competitive impacts, administrative consistency, and good
governance concerns. The Council may not substitute its judgment in
licensing determinations for that of a member board where, in its
sole determination, none of the aforementioned concerns are present.
(c) The Council shall solicit input from and request
the assistance of a member board when considering an application for
issuance or renewal of a license if there are concerns about an applicant
related to the standard of care or professional qualifications. The
Council may specify the format of the input and assistance requested
to satisfy the requirements of this rule.
