| (a) If the commission denies the application for a
product with a valid COLA or fails to act on the application within
the time required by §45.7 of this title, the applicant is entitled
to an administrative hearing before the State Office of Administrative
Hearings.
(b) To request a hearing under this chapter, the applicant
must file a written request for hearing with the commission within
ten (10) business days of:
(1) receiving notification from the commission that
product registration has been denied; or
(2) the expiration of the time limit for commission
action, if the commission has not either approved or denied the application.
