(a) The board adopts the provisions contained in the
Texas Health and Safety Code, Chapter 467, Peer Assistance Programs,
in its entirety, including any amendments enacted by the Texas Legislature.
(b) Should the board receive information regarding
a licensee, applicant or certificate holder indicating possible chemical
dependency on drugs or alcohol or mental health issues, the board
may:
(1) refer the licensee, applicant, or certificate holder
to an approved peer assistance program; or
(2) require the licensee, applicant, or certificate
holder to participate in or complete a course of treatment or rehabilitation.
(c) Should the board receive a complaint or other information
constituting possible violations of other board rules, including chemical
dependency on drugs or alcohol, or mental health issues, then the
board may take action as appropriate under this title and the Act
regarding those possible violations in addition to making a referral
under subsection (b) of this section.
(d) An approved peer assistance program that receives
a report or referral under subsection (b) of this section or a report
under §467.005(a) of the Texas Health and Safety Code, may intervene
to assist the licensee, applicant or certificate holder to obtain
and complete a course of treatment and rehabilitation.
