The following words and terms, when used in this chapter, shall have the following meanings, unless the context clearly indicates otherwise. (1) Board--The State Seed and Plant Board as established under the Texas Agriculture Code, §62.002 which is the board of arbitration for complaints filed under this chapter. As a board of arbitration, the State Seed and Plant Board, also referred to as the Seed Arbitration Board in that capacity, shall conduct arbitration as provided by the Texas Agriculture Code, Chapter 64. (2) Chairman--The chairman of the State Seed and Plant Board. (3) Commissioner--The commissioner of the Texas Department of Agriculture or his designee. (4) Complaint--Unless otherwise noted, a sworn statement filed under the Texas Agriculture Code, Chapter 64, alleging loss or damages incurred as a result of the failure of the seed to produce or perform as represented by warranty or
by the label required to be attached to the seed under the Texas Agriculture Code, Chapter 64 or as a result of negligence. (5) Department--The Texas Department of Agriculture.
