(a)Reportable incidents that occur in an ASC include the following. (1)Complications that result in the death of a patient must be reported. (2)A condition for which the ASC does not have the adequate equipment and/or personnel to care for the patient, which results in an emergency transfer to a hospital from the ASC must be reported. (3)Reports of any fire or other damage sustained at the ASC must be reported. (b)Upon learning of the incident, the ambulatory surgical center shall report the incident to the Texas Department of Health in Austin. A written letter of explanation with supporting documents must be mailed to the department within 30 days of the incident. The mailing address is Texas Department of Health, Health Facility Licensing and Compliance Division, 1100 West 49th Street, Austin, Texas 78756. (c)Any theft of drugs and/or diversion of controlled drugs shall be reported to the local police agency, the State Board of Pharmacy, the Texas Department of Public Safety, and/or the Drug Enforcement Administration, and the Texas Department of Health.
