(a)A distant site physician may delegate tasks and activities to a patient site presenter during a patient encounter. [telepresenter who is qualified by licensing, training or experience for the performance of the task or activity as long as the task or activity does not require the exercise of independent medical judgment for its performance;] (b)A distant site physician delegating tasks or activities to a patient site presenter [telepresenter ] shall ensure that the patient site presenter [telepresenter ] to whom delegation is made is adequately supervised during the patient encounter when telemedicine medical services are provided. The distant site physician may write orders for treatment after the patient encounter to only a licensed health care practitioner. [ qualified by licensure, training, or experience to perform the task or activity delegated;] (c)A patient site presenter must be at the patient site location throughout the patient encounter when the telemedicine medical service is provided. [physician delegating tasks or activities to a telepresenter shall ensure that the telepresenter to whom delegation is made is adequately supervised.]
