Preamble Texas Admin Code Rule

(a)All agreements between or among parties that are reached as a result of Alternative Dispute Resolution must be committed to writing, signed by the respondent or applicant and a board staff attorney and submitted to the board for approval at their next board meeting. Once signed by the board, the agreement will have the same force and effect as a written contract.

(b)If the board does not approve a proposed settlement, the respondent or applicant will be so informed and the matter will be referred to the Director of Standards and Enforcement to pursue appropriate action.

This agency hereby certifies that the proposal has been reviewed by legal counsel and found to be within the agency's legal authority to adopt.
