Preamble Texas Admin Code Rule
(a)To comply with Texas Government Code, §2155.076(a), the Commission [The commission] adopts by reference the rules of [promulgated by] the Texas Facilities [Building and Procurement] Commission regarding purchasing protest procedures as set forth in [Subchapter A of] 1 TAC §111.32 (relating to Protests/Dispute Resolution/Hearing) [§111.3].

(b)The Commission [commission] shall maintain documentation about the purchasing process to be used in the event of a protest by maintaining current information regarding applicable statutory law, administrative rules, and guidelines affecting the purchasing process.

The agency certifies that legal counsel has reviewed the proposal and found it to be within the state agency's legal authority to adopt.
