Preamble Texas Admin Code Rule
(a)The director of enforcement shall ensure that a compliance monitoring program is established and maintained for those licensees who have received a board order or remedial plan. The monitoring program shall be maintained by an SBDE employee assigned to act as the compliance officer.

 (b)Upon determination that a licensee has not complied with the requirements specified in his or her board order or remedial plan, the compliance officer shall report the details of the non-compliance to the director of enforcement.

The agency certifies that legal counsel has reviewed the proposal and found it to be within the state agency's legal authority to adopt.
