(a)The authority for obtaining leased space for state agencies or departments rests with the commission by virtue of Texas Government Code, Title 10, Subtitle D, Chapter 2167. In accordance with §2165.107, Government Code, the commission shall give preference to available state-owned space under its control. (b)The commission shall lease space on the basis of determining the best value for the state. In determining the best value, the commission may consider: (1)the cost of the lease contract; (2)the condition and location of the lease space; (3)utility costs; (4)access to public transportation; (5)parking availability; (6)security; (7)telephone service availability; (8)indicators of probable lessor performance under the contract, such as the lessor's financial resources and the lessor's experience; (9)compliance with the architectural barriers law, Article 9102, Revised Statutes; and (10)other factors deemed relevant by the commission.
This agency hereby certifies that the proposal has been reviewed
by legal counsel and found to be within the agency's legal authority to adopt.
