The Texas State Board of Plumbing Examiners adopts amendments to §365.1, which describes the different license and registration categories administered by the Board and sets forth the scope of work permitted under each category, without changes to the proposed text as published in the August 6, 2004, issue of the Texas Register (29 TexReg 7636).

The amendments to §365.1 are adopted in conjunction with the adoption of amendments to §367.2, Standards of Conduct. The amendments will result in relocating language, which addresses standards of conduct for licensed plumbing inspectors currently contained in §365.1. The language will be more appropriately located in §367.2, which addresses standards of conduct for all of the Board's licensees and registrants. The amendments will not result in any additional requirements for licensed plumbing inspectors to comply with.

No comments were received regarding the proposed amendments.

The amendments to §365.1 are adopted under and affect Title 8, Chapter 1301, Occupations Code, as amended by the 78th Legislature ("Plumbing License Law" or "Law"), §1301.251, and the rule it amends. Section 1301.251 requires the Board to adopt and enforce rules necessary to administer the Plumbing License Law.

No other statute, article or code is affected by the adoption of the amendments.
