The Texas Real Estate Commission (TREC) adopts amendments to §535.62, concerning Acceptable Courses of Study and §535.64, concerning Accreditation of Schools and Approval of Courses and Instructors without changes to the proposed text as published in the August 27, 2004, issue of the Texas Register (29 TexReg 8248) and will not be republished.

The revisions conform the provisions to the repeal of previous and adoption of replacement mandatory continuing education rules including §535.71, concerning mandatory continuing education: approval of providers, courses and instructors, §535.72, concerning presentation of courses, advertising, and records, and §535.73, concerning compliance and enforcement. The factual basis for the revisions is to add a repealed provision from §535.71 regarding the requirements for obtaining TREC approval for core real estate education courses offered by alternative delivery method to §535.62 and to add a reference to the new provision in §535.62 to §535.64. Prior to adoption of the revisions, §535.62 included a cite to §535.71(r) to require core real estate education courses offered by alternative delivery method to comply with the requirements of §535.71(r). The purpose of the revisions is to preserve the current requirements for obtaining TREC approval for core real estate education courses offered by alternative delivery method.

No comments were received regarding the proposed revisions.

The amendments are adopted under Texas Occupations Code, §1101.151, which authorizes the Texas Real Estate Commission to make and enforce all rules and regulations necessary for the performance of its duties and to establish standards of conduct and ethics for its licensees in keeping with the purposed and intent of the Act to insure compliance with the provisions of the Act.

The statute affected by this adoption is Texas Occupations Code, Chapter 1101. No other statute, code or article is affected by the adopted amendments.
