The Texas State Board of Examiners of Psychologists adopts amendments to §465.2, Supervision, without changes to the proposed text published in the September 18, 2009, issue of the Texas Register (34 TexReg 6413) and will not be republished.

The amendments are being adopted to ensure the protection and safety of the public.

The adopted amendments will help to clarify the rule.

The Board received comment from Floyd L. Jennings, J.D., Ph.D. A summary of the comment relating to the proposed rule and the Board's response follow.

Comment: In §465.2(b) the wording should be licensees ensure that supervisees engage only in those acts which they are authorized to provide under the statute and rules.

Response: The agency responds that the language of the rule reflects the intent that supervisors are responsible to determine the legal authority by which a supervisee practices psychology.

The amendments are adopted under Texas Occupations Code, Title 3, Subtitle I, Chapter 501, which provides the Texas State Board of Examiners of Psychologists with the authority to make all rules, not inconsistent with the Constitution and Laws of this State, which are reasonably necessary for the proper performance of its duties and regulations of proceedings before it.
