The Texas Appraiser Licensing and Certification Board (Board) adopts the repeal of §153.24, Processing a Complaint, without changes to the proposal as published in the January 1, 2010, issue of the Texas Register (35 TexReg 24). The repeal is adopted because the subjects addressed in this section will be covered in new §153.24 the Board is simultaneously adopting. The new rule, otherwise explained in this issue of the Texas Register, more accurately and concisely describes the Standards and Enforcement Division's process for handling complaints and incorporates peer investigative committee investigations into the complaint process.

The reasoned justification for the repeal as adopted is that the new rule will provide greater clarity for the public and licensees regarding the complaint process, as well as greater efficiency through the use of peer investigative committees.

No comments were received regarding the repeal as proposed.

The repeal is adopted under the Texas Appraiser Licensing and Certification Act, Subchapter D, Board Powers and Duties (Texas Occupations Code, Chapter 1103), which provides the Board with authority to adopt rules under §1103.151, Rules Relating to Certificates and Licenses and §1103.154, Rules Relating to Professional Conduct.

The statute affected by this repeal is Texas Occupations Code, Chapter 1103. No other statute, code or article is affected by the repeal.
