The Texas Higher Education Coordinating Board (Coordinating Board) adopts amendments to §15.10, concerning Texas Research Incentive Program, with changes to the proposed text as published in the August 19, 2011, issue of the Texas Register (36 TexReg 5178).

Specifically, in compliance with House Bill 51, 81st Texas Legislature, the adopted rule would establish rules regarding the return of donations to donors and the Texas Research Incentive Program. Additionally, the definition of a gift is clarified.

One comment was received concerning the amendments.

Comment: Texas Tech University submitted an edit to the proposed gift definition removing the phrase "for use in the furtherance of the institution" and adding the phrase "that provide a direct benefit to the donor".

Response: The staff concurred and implemented the changes to the definition.

The amendments are adopted under the Texas Education Code, §§62.121 - 62.124.
