The Texas Appraiser Licensing and Certification Board (TALCB) adopts amendments to §153.9, concerning Applications. The amendments are adopted without changes to the proposed text as published in the June 8, 2012, issue of the Texas Register (37 TexReg 4172).

The amendments are adopted to implement the relevant provisions of Senate Bill 1733, 82nd Texas Legislature, Regular Session (2011). Senate Bill 1733 amends Texas Occupations Code to add §55.004 regarding spouses of active duty military to allow for alternate demonstrations of competency to meet license requirements, establishes a period during which an otherwise qualified person may seek employment or practice with an expired license, and authorizes the TALCB Commissioner to issue licenses by endorsement. The bill authorizes a state agency to adopt rules to allow alternative demonstrations of competency to meet the requirements for obtaining the license under the new section. The amendments to §153.9 establish the criteria to be used to demonstrate competency under the new section.

The reasoned justification for the amendments to §153.9 is the establishment of criteria to determine alternate demonstrations of competency to meet license requirements for a spouse of a person serving on active duty in the military.

No comments were received on the proposed amendments.

The amendments are adopted under Texas Occupations Code, §1103.151, which authorizes the TALCB to adopt rules necessary for certifying or licensing an appraiser.

The statute affected by the amendments is Texas Occupations Code, Chapter 1103. No other statute, code or article is affected by the amendments.
