The Texas Appraiser Licensing and Certification Board (TALCB) proposes an amendment to §153.20, concerning Guidelines for Revocation, Suspension, Denial of Licensure or Certification; Probationary Licensure. The amendment is proposed to clarify that a sponsor who refuses to sign an appraiser trainee's experience log and affidavit for experience actually and lawfully acquired is subject to sanctions by TALCB.

Kerri Lewis, Acting General Counsel, has determined that for the first five-year period the proposed amendment is in effect, there will be no fiscal implications for the state or for units of local government as a result of enforcing or administering the section. There is no anticipated significant impact on small businesses, micro-businesses or local or state employment as a result of implementing the section. There is no significant anticipated economic cost to persons who are required to comply with the proposed amendment.

Ms. Lewis also has determined that for each year of the first five years the section as proposed is in effect the public benefit anticipated as a result of enforcing the section will be better compliance with existing requirements for sponsors to sign experience logs for trainees, thereby helping appraiser trainees to better track and submit the experience necessary to become a licensed appraiser.

The amendment is proposed under Texas Occupations Code, §1103.151, which authorizes the Texas Appraiser Licensing and Certification Board to adopt rules relating to certificates and licenses, and §1103.154, which authorizes TALCB to adopt rules relating to the professional conduct of a licensed or certified appraiser.

The statute affected by the amendment is Texas Occupations Code, Chapter 1103. No other statute, code or article is affected by the proposed amendment.
