The Texas Appraiser Licensing and Certification Board (TALCB) adopts an amendment to §153.11, concerning Examinations, without changes to the proposed text as published in the December 13, 2013, issue of the Texas Register (38 TexReg 8995).

The amendment is adopted to simplify the requirements for additional education following three consecutive examination failures.

The reasoned justification for the amendment is that the additional educational requirements will be clearer for both staff and applicants whenever an applicant fails the exam three consecutive times.

No comments were received on the amendment as proposed.

The amendment is adopted under Texas Occupations Code, §1103.151, which authorizes TALCB to adopt rules relating to certificates and licenses; and §1103.152, which authorizes TALCB to prescribe qualifications for appraisers that are consistent with the qualifications established by the Appraiser Qualifications Board.

The statute affected by the amendment is Texas Occupations Code, Chapter 1103. No other statute, code or article is affected by the adopted amendment.
