The Texas State Board of Plumbing Examiners (Board) adopts amendments to 22 TAC §367.10 with changes to the proposed text as published in the February 6, 2015, issue of the Texas Register (40 TexReg 514). This rule grants the Board greater flexibility to settle cases and greater enforcement authority.

The change to §367.10(f) emphasizes that the Board ultimately decides the appropriate sanction or outcome of a contested case. Subsection (l) shifts the cost of preparing an administrative record to the respondent challenging the Board's final order.

Subsections (h) and (i) merge the factors set forth in Occupations Code §1301.702(b) and the administrative penalty schedule.

No comments were received on the proposed amendment.

The amendment is adopted under and affects Chapter 1301 of the Texas Occupations Code (Plumbing License Law). Occupations Code §1301.251 requires the Board to adopt and enforce rules necessary to administer the Plumbing License Law.

No other statute, article, or code is affected by the adopted rule.
