The Comptroller of Public Accounts proposes an amendment to §5.1 regarding definitions. This amendment is proposed in conjunction with an amendment to §5.22 regarding State of Texas travel guidance. These proposed amendments clarify that a transportation network driver is considered to be a "commercial transportation company" under Government Code, §660.092, allowing a state agency to pay or reimburse the expense of transporting a state employee when the transportation is provided by a transportation network driver, and the amendments delete a definition that has become obsolete.

Paragraph (3) is deleted because that definition has become obsolete. Subsequent paragraphs are renumbered accordingly.

New paragraphs (6) and (7) add definitions of "transportation network company" and "transportation network driver." These terms are used in the proposed amendment to §5.22. Subsequent paragraphs are renumbered accordingly.

Tom Currah, Chief Revenue Estimator, has determined that for the first five-year period the rule will be in effect, there will be no significant revenue impact on the state or units of local government.

Mr. Currah also has determined that for each year of the first five years the rule is in effect, the public benefit anticipated as a result of enforcing the rule will be by clarifying travel provisions for government agencies and their employees. The proposed amendment would have no fiscal impact on small businesses. There is no significant anticipated economic cost to individuals who are required to comply with the proposed rule.

This amendment is proposed under Government Code, §660.021, which authorizes the comptroller to adopt rules relating to the administration of travel provisions for the State of Texas.

This amendment implements Government Code, §660.092, regarding payment and reimbursement methods.
