The Texas State Board of Plumbing Examiners (Board) adopts the repeal of 22 TAC Chapter 367, concerning Enforcement, without changes to the proposed text as published in the April 27, 2018, issue of the Texas Register (43 TexReg 2519), and will not be republished. The Board adopts this repeal contemporaneously with the adoption of a new Chapter 367.

Public Comments

No comments were received regarding the proposed repeal of Chapter 367. A public hearing, in accordance with §2001.029 of the Texas Government Code, was not required.

Statement of Authority

The repeal of Chapter 367 is made under the authority of §1301.251(2) of the Texas Occupations Code, which requires the Board to adopt and enforce rules necessary to administer and enforce said chapter, and §2001.039 of the Texas Government Code, requiring a state agency to review its rules every four years. No other statute, article, or code is affected by the repeal. The repeal of Chapter 367 has been reviewed by legal counsel and found to be within the state agency's authority to adopt.
