The Texas State Board of Dental Examiners (Board) adopts an amendment to 22 TAC §102.1, concerning fees, with changes to the proposed text as published in the June 22, 2018, issue of the Texas Register (43 TexReg 4003). The changes to the published text of the attached graphic are as follows:

Temporary Licensure by Credentials renewal - add $1 NPDB charge

Nitrous Level 1 Permit Renewal - added the word "nitrous"

Temporary Licensure by Credentials renewal - add $1 NPDB

DH Application to Reactivate a Retired License - $3 Texas Online subscription fee, $2 Peer Assistance fee, $1 Patient Protection fee and $1 NPBD fee

DH Reinstatement of a Cancelled Dental Hygiene License $3 Texas Online subscription fee

DA annual renewal fee - increase to $62 for biennial renewal

DA annual renewal late 1 to 90 days - increase to $77

DA annual renewal late 91 to 365 days - increase to $92

DA Nitrous Oxide conscious sedation monitoring application - increase to $25

This amendment makes corrections to fees the Board already assesses. This amendment will increase fees to account for the Board changing to biennial renewal as well as providing funding for the anesthesia program. This amended rule incorporates requirements due to enactment of SB 313 and changes to the General Appropriations Act in the eighty-fifth Texas Legislature Regular Session, 2017, relating to the continuation and functions of the Texas State Board of Dental Examiners, resulting in an appropriations increase of $222,943 in fiscal year 2019.

No comments were received regarding adoption of this amended rule.

This amendment is adopted under Texas Occupations Code §254.001(a), which gives the Board authority to adopt rules necessary to perform its duties and ensure compliance with state laws relating to the practice of dentistry to protect the public health and safety, and Texas Occupations Code §254.004, which authorizes the Board to collect sufficient fees to cover the cost of administering the Dental Practice Act.
