The Texas Appraiser Licensing and Certification Board (TALCB) adopts amendments to 22 TAC §153.24, Complaint Processing, without changes to the proposed text as published in the February 22, 2019, issue of the Texas Register (44 TexReg 792), and the amendments will not be republished.

Section 153.24 establishes criteria for TALCB to investigate and process complaints received against appraisers. The TALCB Enforcement Committee recommends adoption of the amendments to implement recommendations from the Sunset Commission directing TALCB to prioritize complaint investigations based on the risk of harm each complaint poses to the public and to improve TALCB's investigative process and reduce complaint resolution timeframes.

The amendments clarify the process and set forth the criteria for prioritizing complaint investigations for complaints against appraisers. The amendments also clarify who must sign agreed resolutions of complaint matters under Tex. Occ. Code §§1103.458 - .459.

No comments were received regarding adoption of the amendments.

The amendments are adopted under Occupations Code §1103.151, which authorizes TALCB to adopt rules for certifying or licensing an appraiser or appraiser trainee in this state that are in accordance with Chapter 1103 and consistent with applicable federal law.
