The Texas Department of Public Safety (the department) adopts amendments to §4.15, concerning Compliance Review and Safety Audit Programs. This rule is adopted without changes to the proposed text as published in the April 12, 2024, issue of the Texas Register (49 TexReg 2256) and will not be republished. The proposed amendment adds as an imminent hazard to the public a motor carrier's refusal to submit to an inspection and the practice of employing unqualified drivers with fraudulent foreign commercial driver licenses. It also specifies the documentation and retention requirements for a motor carrier that employs foreign commercial driver license personnel consistent with House Bill 4337, 88th Leg., R.S. (2023). No comments were received regarding the adoption of this rule. This rule is adopted pursuant to Texas Transportation Code, Section 644.051, which authorizes the director to adopt rules regulating the safe transportation of hazardous materials and the safe operation of commercial motor vehicles; and authorizes the director to adopt all or part of the federal safety regulations by reference. |
