In the January 28, 2022, issue of the Texas Register (47 TexReg 318), the Texas Commission on Environmental Quality (commission) adopted amendments to 30 TAC §335.504. The text for 30 TAC §335.504(a)(1) contained an incorrect Federal Register citation for 40 Code of Federal Regulations Part 261, Subpart A. The citation for Subpart A was listed as February 22, 2019 (84 FR 5816) when it should have been December 9, 2019 (84 FR 67202). The error is as submitted by the commission.

The text of 30 TAC §335.504(a)(1) should be corrected to read as, "A person must determine whether the material is excluded or exempted from regulation as a solid waste or as hazardous waste under the definition of solid waste in §335.1 of this title or identified in 40 Code of Federal Regulations (CFR) Part 261, Subpart A as amended in the Federal Register through December 9, 2019 (84 FR 67202), or Subpart E as amended in the Federal Register through August 6, 2018 (83 FR 38262)".
