| (a) Before disturbance of areas affected by surface operations, topsoil and subsoils to be saved under §12.505 of this title (relating to Topsoil: Removal) shall be separately removed and segregated from other material. (b) After removal, topsoil shall be immediately redistributed in accordance with §12.507 of this title (relating to Topsoil: Redistribution), stockpiled pending redistribution under §12.506 of this title (relating to Topsoil: Storage), or if the permittee can demonstrate that an alternative procedure will provide equal or more protection for the topsoil, the Commission, may, on a case-by-case basis, approve an alternative.
