RULE §730.1704Emergency Release/Use of Data

Although abuse, neglect, or exploitation data is not usually released pending the results of the release hearing, data may be adversely used against an alleged perpetrator if the department determines that he constitutes an immediate danger to the health or safety of children or aged or disabled adults. The evidentiary standards for this determination are set forth in the program rules on which the action is based.
