RULE §700.517Investigation of Lack of Medical Care Because of Religious Beliefs

(a) The Texas Department of Protective Services' Office of Protective Services for Families and Children investigates allegations of lack of medical care because of religious beliefs if the child's condition appears to involve medical neglect.

(b) A parent or guardian is not considered negligent if he fails to provide a child with specific medical treatment because of a legitimate practice of his religion. However, staff may still request a court order to provide medical services if the child's health requires it.
